BUILDING CODE

A. The Minnesota State Building Code, established pursuant to Minnesota Statutes 326B.101, including all of the amendments, rules and regulations established, adopted, and published from time to time by the Minnesota Commissioner of Administration, through the Building Codes and Standards Division is hereby adopted by reference as to the building code for this jurisdiction, excepting of the optional chapters unless specifically adopted in Section 9-1-1.B of this Chapter. The code is hereby incorporated in this Section as if fully set out herein. B. The Minnesota State Building Code, established pursuant to Minnesota Statutes 326B.101 allows the Municipality to adopt by reference and enforce certain optional chapters of the most current edition of the Minnesota State Building Code. The following optional provisions identified in the most current edition of the State Building Code are hereby adopted and incorporated as part of the building code for this Municipality. 1\. Reserved. C. The Minnesota Plumbing Code, established pursuant to MN Rules, Chapter 1300, allows the municipality to adopt by reference and enforce the Minnesota Plumbing Code. 1\. Plans and Specifications Required. a. Prior to installation of a system of plumbing other than for an IRC structure with independent plumbing service, complete plumbing plans and specifications, together with any additional information that the Building Official may require, shall be submitted in duplicate for review and approved by the Building Official. <!-- PageNumber="1" --> <!-- PageBreak --> b. Plans shall be submitted to the Department of Labor and Industry for state-licensed facilities; public buildings; and projects of a special nature for which department review is requested by either the municipality or the state. C. No construction shall proceed except in accordance with the approved plans. 2\. Existing Plumbing Systems. Any alteration or extension of any existing plumbing system shall be subject to the requirements as outlined herein. 3\. Inspections Required. A plumbing system installation, as described herein, shall be subject to inspections conducted by the municipality as required by the Minnesota Plumbing Code in accordance with MN Rules Chapter 1300.0215, subp. 1-5. 9-1-2: APPLICATION, ADMINISTRATION AND ENFORCEMENT: The application, administration and enforcement of this Section shall be in accordance with the MN State Building Code and the MN State Plumbing Code. The code shall be enforced within the extra territorial limits permitted by Minnesota Statutes 326B.101 when so established by the City Code: A. The issuance of building permits and the collection of fees shall be as authorized in Minnesota Statute §326B.151. B. A surcharge fee shall also be collected on all permits issued for work governed by this Section in accordance with Minnesota Statutes §326B. 148. C. Building permit fees and plumbing permit fees shall be assessed in accordance with Section 1-2-2 of the City Code for work governed by this Section. SECTION 2. The City Council for the City of Nowthen hereby ordains: SECTION 1. City Code Section 1-2-2, Fee Schedule, is hereby amended regarding building permits and inspections: C. Building Permits and Inspections 1\. The valuation determined for a project shall be by legal means and used in determining fees as stipulated by the 1997 Uniform Building Code method. This provides for the fee to be adjusted in accordance with the total cost of the project. The 1997 UBC document is available on the State of Minnesota Website http://www.doli.state.mn.us/ and offered as an option for jurisdictions to use when calculating fees. 65% of Permit Fee a. Plan Check/Document Evaluation for Residential and Commercial Projects b. Master Plan When submittal documents for similar plans are approved, plan review fees shall not exceed 25% of the normal building permit fee established and charged for the same structure. Plan review fee for the original plan review is 65% of Permit Fee. 25% of Plan Review C. Changing vent systems, running new drain or supply lines, or replacing or installing new ductwork, pipes or vents is not fixture maintenance. (Examples: Sink, Toilet, Water Softener, Hose Bib, or Water Heater replacement) ### C. A. The Planning Commission is established as a recommending body to the City Council and as such has no power to compel the City to take any actions or incur any obligations, financial or otherwise.
